Book: Lei Anticorrupção e FCPA: Comparativo de Efetividade (Portuguese Edition) – 2020

A corrupção é um problema endêmico social que atinge o mundo inteiro. Alguns países conseguem combater a corrupção de forma adequada com resultados positivos, enquanto outros sofrem pela falta de implementação de instrumentos necessários para enfrentar este mal e seus efeitos devastadores.

O Brasil, em sua história mais recente tem passado por grandes escândalos envolvendo atos de corrupção, o que resultou na homologação da Lei Anticorrupção n° 12.846/2013. A lei qual é destinada à responsabilização objetiva administrativa e civil de pessoas jurídicas pela prática de atos contra a administração pública, nacional ou estrangeira.

Por outro lado, os Estados Unidos, um país exemplo no combate de corrupção, durante a sua história, passou por inúmeros escândalos de corrupção e em 1977 homologou o U.S. Foreign Corrupt Practices Act (FCPA) para combater a corrupção, em decorrência de subornos a dirigentes governamentais no exterior por empresas americanas. A FCPA e o seu escopo foram emendados em 1988. Desde então, a lei vem sendo aplicada e pode servir como uma ferramenta para análise mais profunda da funcionalidade das leis anticorrupção.

O problema em foco neste livro é a corrupção, e o seu tratamento no Brasil e nos Estados Unidos, buscando aclarar as similaridades e diferenças entre a Lei Anticorrupção n° 12.846/2013 do Brasil e a Foreign Corruption Practice Act (FCPA) dos Estados Unidos.

Será demonstrado a análise realizada através da coleta da base de dados em sítios eletrônicos; no caso do FCPA, através do Stanford Law School Foreign Corrupt Practices Act Clearinghouse, um repositório de documentos originais da Comissão de Valores Móveis (Securities and Exchange Commission - SEC) e do Departamento de Justiça, e no que diz respeito à lei n.° 12.846/2013, através dos dados coletados no sítio do Ministério da Transparência e Controladoria-Geral da União (CGU), divulgados no Cadastro Nacional de Empresas Punidas (CNEP), disponível no Portal da Transparência. A pesquisa analisou dados desde a entrada em vigor da Lei Anticorrupção n.° 12.846, em janeiro de 2014.
